General conditions of sale in the online stores of Silvio S.L. (calzadossilvio.com and calzadocomodo.net)

This document establishes the general conditions of the contractual relationship that aims at the sale of products of SILVIO SL (hereinafter CALZADOSSILVIO) with registered office at C / Royo 5 and 7 in Zaragoza, with CIF B50347004 and in his name and representation Mr. Alberto Fernández Álvarez with NIF 29111561R, by natural and / or legal persons (hereinafter CONTRACTOR) who express their willingness to buy the products and services that are find on the website www.calzadossilvio.com by requesting via the internet through that website. These requests from users constitute the particular conditions to which these general conditions are associated, which the CONTRACTOR must necessarily accept electronically prior to the purchase of the product. The CONTRACTOR is exposed through the website www.calzadossilvio.com these conditions, so that he reads, prints, archives and accepts them, and the CONTRACTOR cannot buy the product without this acceptance having occurred. The CLIENT will always have these general conditions on a visible site of the web. The domain under which CALZADOSSILVIO acts has been duly notified to the Mercantile Registry of Zaragoza with the following data: Ins. Reg Merc de Zaragoza, Volume 2304, Book 0, Folio 159, Sheet Z-23188 Incs. 3.

These general conditions together with the request for specific products made by the CONTRACTOR -particular conditions- imply the formalization of the contract of sale between THE OWNER and the CONTRACTOR who claims to have read, understood and accepted these conditions.

FIRST.- Object and scope of application.-
The purpose of these General Conditions of Contract and Use is to regulate the provision of the information provided in the online stores of calzadossilvio.com and www.calzadocomodo.net, as well as the commercial transactions that arise between calzadossilvio.com, calzadocomodo.net and the users of the calzadossilvio.com domain and www.calzadocomodo.net. Both browsing the online store and the acquisition of any of the products offered in it, imply the acceptance as a user, without reservations of any kind, of each and every one of these general conditions of contract and use. calzadossilvio.com may at any time and without prior notice, modify these general conditions of contracting and use, as well as the particular conditions that, where appropriate, are included, by publishing said modifications in the store so that they can be known by users, and being recorded the date of said modifications.

SECOND.- RIGHTS AND OBLIGATIONS OF THE OWNER.-
2.1. Delivery of the product.- THE OWNER undertakes to deliver the product in perfect condition to the address that the CONTRACTOR indicates in the order form where the particular conditions that join these general conditions are recorded. THE OWNER will not be responsible for errors caused in the delivery when the data entered by the CONTRACTOR in the order form do not conform to reality or have been omitted.

2.2.Responsibility of THE OWNER.- THE OWNER in no case will be responsible in relation to:
2.2.1. Errors, delays in access by the CONTRACTOR when entering their data in the order form, the slowness or impossibility of receipt by the recipients of the order confirmation or any anomaly that may arise when these incidents are due to problems in the Internet network, causes of fortuitous event or force majeure. In any case, THE OWNER undertakes to solve the problems that may arise and to offer all the necessary support to the CONTRACTOR to reach a quick and satisfactory solution of the incident.
2.2.2. Of the errors or damages produced by an inefficient and bad faith use of the service by the CONTRACTOR.
2.2.3. Of the non-operability of the email address provided by the CONTRACTOR for the sending of the order confirmation within twenty-four hours from when it is made.

2.3. THE OWNER has absolute responsibility for the quality of the products, admitting the return of the same as long as they are defective or do not reach the CONTRACTOR in correct condition. THE OWNER will be responsible, in this case, for the expenses incurred as a result of such return provided that the CONTRACTOR communicates this fact. The CONTRACTOR, before signing the delivery of the order, must ensure that the packaging arrives in perfect condition, without blows or any type of deterioration. It is the obligation of the CONTRACTOR to refuse the order if the packaging is damaged or damaged.

In case of defective product, THE OWNER must proceed, as appropriate, to the repair, replacement, price reduction or termination of the contract, procedures that will be free for the CONTRACTOR. THE OWNER is responsible for the lack of conformity that manifests itself within a period of two years from delivery. The CONTRACTOR must inform the seller of the lack of conformity within two months of becoming aware of it.

The responsibility of THE OWNER if it fails to comply with the provisions of this agreement according to the terms of these general conditions will be limited to the exchange of the product or the refund of the amount that, where appropriate, the CONTRACTOR could have paid and always after return by the CONTRACTOR of the product in question.

THIRD.- RIGHTS AND OBLIGATIONS OF THE CONTRACTOR.-
3.1. Payment.- The CONTRACTOR undertakes to pay in advance the amount for the product actually requested in the following amount and form:
3.1.1. Amount.- The remuneration for the product actually requested by the CONTRACTOR depending on the product requested will be the one indicated on the website and the one that appears in the specific request of the CONTRACTOR at all times, requests that will constitute the particular conditions of the specific order. CALZADOSSILVIO will send within twenty-four hours confirmation of the order and its total amount. The prices of the products that appear on the website always appear with VAT included.

In addition, the price shown on the website for each of the products offered must be added to the relevant shipping costs.

CALZADOSSILVIO will send through a logistics operator or transport agency with a price that will be indicated in the order confirmation and with a delivery time of 48/72 hours of working days for national shipments (Except canary islands, Ceuta and Melilla, Europe and the rest of the world).

Shipping costs will be free from 50 euros VAT included in Spain and (Except Balearic Islands, Canary Islands, Ceuta and Melilla, Europe and rest of the world)

Shipping costs to the Canary Islands, Ceuta, Melilla and areas outside the European Customs Union do not include import costs (tariffs), which will be paid in cash at destination by the recipient of the goods.

As these are rates that at no time applies CALZADOSSILVIO, note that they will always be those offered by the companies by virtue of the address and weight of the shipment and that CALZADOSSILVIO will communicate the global cost of both the product and the shipping costs always previously to the CONTRACTOR in the confirmation of the purchase request.

These prices are indicative, since the price of transport varies depending on the weight and volume of the package.

Spain (Balearic Islands) Seur from 9.5 euros.
Spain (Ceuta and Melilla) Seur from 17.42 euros.
Spain (Canary Islands) Seur from 14.37 euros.
Europe from 16.36 euros, depending on the country of destination.
Rest of the world from 25.20 euros, depending on the country of destination.


3.1.2. Payment methods.- The CONTRACTOR must pay the amount corresponding to the contracted service by:

3.2. Withdrawal and return of products.- The products offered in www.calzadossilvio.com and www.calzadocomodo.net admit right of withdrawal as long as the product is returned in the same conditions in which it was delivered and with the packaging in perfect condition. The deadline to withdraw is 14 working days from receipt of the order. The return shipping costs will always be borne by THE CONTRACTOR. Once the merchandise has been received in our warehouses, and after checking the status of the same, the amount will be refunded in the terms established in RDL 1/2007, according to the payment method made by the customer, except payment in cash, which will be refunded by bank transfer.

3.3. Product Warranty.
The warranty period is, by default, two years. The warranty does not include deficiencies caused by negligence, blows, incorrect use or improper manipulations, incorrect installations, etc., or materials that are worn out by use. During the warranty time, CALZADOSSILVIO reserves the right to request an official technical service of the brand, a verification of the origin of the problem. In case of a defect caused by misuse, the repair will be billable. In those incidents that justify the use of the guarantee, the repair, replacement of the article, rebate or return will be chosen, in the legally established terms. CALZADOSSILVIO will make changes or returns provided that:



a) Prior communication is given to our Customer Service: This step is essential whatever the reason for the return. You can do this by sending us an email to ventas@calzadossilvio.com or by calling us by phone at 976 483 928 We will tell you how you can act for the return of the item. Our telephone service hours are from 9:00 a.m. to 6:00 p.m. from Monday to Friday.


b) The item to be returned must be properly packed for return. The packaging must be in perfect condition and keep all its accessories and instructions of origin. 


c) After the verification, and if the above conditions are met, CALZADOSSILVIO, will proceed, as appropriate, to the repair, replacement, price reduction or termination of the contract, procedures that will be free for the consumer and user. CALZADOSSILVIO is responsible for the lack of conformity that manifests itself within a period of two years from delivery. The consumer or user must inform the seller of the lack of conformity within two months of becoming aware of it.


FOURTH.- PROTECTION OF PERSONAL DATA:
4.1.- Information to the user of the existence of a file and request for consent for the automated processing of data: In relation to the personal data provided by the USER in the forms that may exist on both websites, CALZADOSSILVIO strictly complies with the current regulations established in Law 15/1999 on the Protection of Personal Data and other legislation that develops it and informs the USER that the aforementioned data will be included in a file for automated processing giving the USER consent by accepting these conditions general to such treatment.

4.2.- Purpose of the data: CALZADOSSILVIO collects and processes certain personal data that are freely entered by the USER in the form in order to be able to answer the requests for information that may be made as well as to be able to manage the purchases that are made and send commercial offers to all those interested in their products. 4.3.- Mandatory data entry: The fields in which an asterisk appears* in the existing forms are those that require a mandatory response and if not covered the consequence would be impossible to buy or request the information that is needed.

4.4.- Rights of access, rectification, cancellation and opposition: The USER who enters their personal data in the different registration forms will have the full right to exercise their rights of access, rectification, cancellation and opposition at any time by requesting it to protecciondedatos@calzadossilvio.com or by postal mail to Silvio S.L., C / Royo nº 5 and 7, Zaragoza 50006.

4.6.- Transfer of data.- CALZADOSSILVIO informs the USER that there will be no type of transfer of data to third parties. The only communications of the data that may be made are the logical ones for the very purpose with which they were introduced, for example to transport companies to proceed to deliver the products at home, communication therefore derived from the freely accepted legal relationship.

4.7.- Security.- CALZADOSSILVIO ensures the absolute confidentiality and privacy of the personal data collected and therefore essential security measures have been adopted to avoid alteration, loss, treatment or unauthorized access and thus guarantee its integrity and security. CALZADOSSILVIO will not be responsible in any case for the incidents that may arise around the personal data when they derive either from an attack or unauthorized access to the systems in such a way that it is impossible to detect by the security measures implemented or when it is due to a lack of diligence of the USER regarding the guard and custody of their access codes or their own personal data.

4.8. Veracity of the data.- The USER is responsible for the veracity of their data, committing not to enter false data and to proceed to modify them if necessary either by requesting it directly in ventas@calzadossilvio.com or by accessing the private area from which they can be modified.

EIGHTH.- JURISDICTION AND APPLICABLE LAW.-
These General Conditions are governed by Spanish law. The parties submit, at their option, for the resolution of conflicts and waiving any other jurisdiction, to the courts and tribunals of the user's domicile.

NINTH.-
In the event that any clause of this document is declared null and void, the other clauses will remain in force and will be interpreted taking into account the will of the parties and the very purpose of these conditions. CALZADOSSILVIO may not exercise any of the rights and faculties conferred in this document, which will not imply in any case the waiver of them unless expressly recognized by CALZADOSSILVIO.
